About these Terms of Use

These website terms of use ("terms of use") and the associated Privacy Policy govern your access to and use of the website, the purchase of any product or services from the website, and any statement or communication in any form made in relation to the website.

Your access and/or use implies agreement 

The website is available for your use only on the condition that you agree to these terms of use. By accessing/using the website, and immediately upon completion of your online registration and our receipt of your registration fees (if any), you agree to be legally bound by these terms. Any third party who uses or accesses the website through your internet connection is similarly bound by these terms.

Fees and invoices

Access to the website, registration as a member and posting a job advert on the website may have a fee attached to it. These charges are set out on the Credenxia home page. Depending on the paid subscription level you select, your nominated credit card will be charged on a recurring monthly or annual basis. If you upgrade, downgrade or cancel your paid subscription, we will charge or refund to your credit card the appropriate pro-rata amount. Credit card transactions are processed by a third party using secure web connections based on SSL certificates. Credenxia does not store any of your credit card details.

Credenxia may change the fees from time to time. Any changes to the fees will be posted on the website and communicated by email. 

Credenxia reserves the right to temporarily change any applicable fees for promotional events or new offers. Any such changes are subject to additional terms solely determined by Credenxia at the time of this temporary change. When such offers or promotions expire, fees shall revert to those listed in the price list.

You are responsible for paying fees when due. If the fees are unpaid when due, Credenxia reserves all rights to issue reminders and restrict or refuse your use of the website or take all legal steps to recover the fees not paid when due. If fees remain unpaid, your membership subscription shall revert to the appropriate free subscription, and all rights held by you as a paid member shall be forfeited. 

Our fees are quoted in Australian Dollars. At the end of the payment process you will receive a tax invoice or receipt that can be printed for your reference. This may also be sent to the email address you have provided to us.

Licence and ownership

All content in any form found on this website is owned or licenced by Credenxia and is protected at all times to the fullest extent of the law under all relevant intellectual property legislation, which includes but is not limited to:

  • the Copyright Act 1988 (Cth);
  • the Trade Marks Act 1995 (Cth);
  • the Patents Act 1990 (Cth);
  • the Designs Act 2003 (Cth); 
  • all associated regulations made under these Acts; and
  • where appropriate, reciprocal or equivalent legislation as enacted in other countries. 

Credenxia reserves all rights available to it under law in relation to the use and ownership of all content found on the website.

No material on this website may be reproduced, adapted, uploaded to a third party, hacked into, attempted to be hacked into, linked to, framed, performed in public, distributed or transmitted in any form or by any process without the specific written consent of Credenxia.

Termination 

Credenxia may terminate your membership and your access to the website if we consider you have breached these terms. If we terminate your access accordingly we may (but in no way guarantee) refund any pre-paid amounts made by you less any reasonable costs and losses we have incurred due to your breach. Credenxia can, at its sole discretion, terminate your membership at any time by giving you reasonable advance written notice.

You may cancel your membership at any time within the website. Cancellation of membership cannot be back-dated. 

Modifications to the Terms

Credenxia may revise and update these terms of use at any time. Any continued use by you of the website after any changes to these terms of use will indicate to Credenxia that you accept all of those changes.

Credenxia does not warrant the accuracy, adequacy or completeness of material on this website. 

You are solely responsible for, and Credenxia does not claim any ownership of or association with, all information and content that you upload to the website or a communication service. Limitation of liability

Credenxia’s liability in relation to any inaccurate or misleading information on the website is limited to actual damages suffered only. In no event shall Credenxia be liable for any incidental, direct, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the website.

In all cases, you agree and acknowledge that Credenxia’s liability for damages caused by a non-excluded inaccurate or misleading warranty or representation on the website is limited to the fullest extent of the law to $500.00.
